Whenever a party is injured, there are many questions that arise as to what to do next, what to do to protect your loved one, and where to even begin. These questions are all good questions, and questions that we receive from most of our clients. We wanted to give you some inside information to help make your choice clearer, keeping in mind in is always best to contact us for a free consultation to answer these questions directly. Here are some of the questions and answers.

Q: How long do I have before I must file a lawsuit?
A: The amount of time you have to file your claim is controlled by the Statue of Limitations. The statute applicable to your case will vary depending on several factors. A few of these factors are: the type of case involved, if the matter involves a death, whether a minor is involved, or if a probate estate has been opened. If you intend on filing a claim, it is necessary to speak with an attorney as soon as possible, since once the statute of limitation has expired, your claim for your injuries may be forever barred. Q: How much does it cost me to talk to you and for you to represent me?

A: At Turner and Turner, we only charge a fee if we produce a recovery on your behalf. In other words, you generally will not be charged a fee unless your case settles or receives a favorable jury verdict. When your case is filed with the court, we create an account for your file and tabulate the legal costs and attorney fees throughout the course of your lawsuit. If your case settles, or you receive a favorable jury verdict, and we recover on your behalf, the costs will be deducted from your settlement. And because filing and other legal costs are charge to your account, we make every effort to control them.

Q: What do you look for in seeing whether I have a case?
A: This question is tough to answer, but here is a summary of what we do. We research case law, law formed by the decisions of judges throughout the area and the State of Michigan, including the Supreme Courts of both Michigan and the United States. We research whether the law is in your favor and whether we can apply such a law to your case. We research liability, commonly known as fault. Whose fault was the injury? Can you receive compensation for your injury? Was the other party negligent, or whether what they failed to do cause your injury? If we find fault, or even a failure to act, we then look to see what you can recover. Sometimes, these damages are set at a maximum amount, sometimes they are not. We look to see what you can recover and the best way to handle the case.
Q: What is my case worth?
A: Your attorney may evaluate the value of your claim based on LIABILITY (the degree of the other party’s fault) and DAMAGES (the severity of your injuries).
