| Q: |
How long do I have before I must file a lawsuit? |
| A: |
The amount of time you have to file your claim is controlled by the Statute of Limitations. The statute applicable to your case will vary depending on several factors. A few of these factors are: the type of case involved, if the matter involves a death, whether a minor is involved, or if probate has been opened. If you intend on filing a claim, it is necessary to speak with an attorney as soon as possible, as after the statute of limitations has expired, your claim for your injuries may be forever barred. If you contact our office, one of our consultants can provide the information applicable to your individual case. . |

At Turner and Turner, P.C., we only charge a fee if we produce a recovery on your behalf. In other words, you generally will not be charged a fee unless your case settles or receives a favorable jury verdict. When your case is filed with the court, we create an account for your file and tabulate the legal costs and attorney fees throughout the course of your lawsuit. If your case settles, or you receive a favorable jury verdict, and we recover on your behalf, the costs will be deducted from your settlement. And because filing and other legal costs are charged to your account, we make every effort to control them. |

There are four major criteria that affect your case:
Case law:
In your situation, is the law in your favor?
Does the law support your claim and apply to your case?
Liability:
Did the other person do anything wrong legally?
Did he/she neglect to do what was required?
Damages:
Are there damages as a result of your alleged claim?
Will we recover a reasonable monetary amount in respect to the cost of your lawsuit?
Statute of Limitations:
Have they expired? See above for more detailed information. |

Your attorney may evaluate the value of your claim based on LIABILITY (the degree of the other party's fault) and DAMAGES (the severity of your injuries). |
