
Our client was a 25-year old passenger in a pick-up truck riding with three (3) other men after leaving several bars. They were on a country type dirt road in Oakland County sometime after 2:00 a.m.
Suddenly there was a sharp "S" curve, which the vehicle was not able to maneuver in time. As a result, the pick-up truck left the road, flipped into a marsh landing on its roof, slid through muck and blew out the windshield. Michigan Law provides for a 55 MPH speed limit on any unmarked roads. There was no speed limit sign, no curb sign, no target arrows, nor reflectors on this unlit country road. Because of this negligence to safely mark the road and dangerous "S" curve, the four (4) young males died.
This case was ultimately settled in Oakland County for $400,000 against the driver and owner of the vehicle and $450,000 against the Road Commission.
